These Terms & Conditions (“Terms”) govern your access to and use of AI Executives OS (the “Service”), available at theaiexecutives.com and app.theaiexecutives.com. By using the Service, you agree to these Terms.

1. About AI Executives OS

AI Executives OS is a platform that provides AI-powered executive personas (Marcus, Ethan, Priya, Alex, Eve, and others) to assist with executive decisions, meetings, and operations. The Service integrates with calendars, meetings, SMS, voice, and other tools to operate as an executive operating layer.

2. Account Registration

2.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding agreements.

2.2 Accurate Information

You agree to provide accurate information during registration and keep it current.

2.3 Account Security

You are responsible for maintaining your account credentials and for all activities under your account.

3. AI Personas and Their Limitations

3.1 Nature of AI Personas

The executive personas (Marcus, Ethan, Priya, Alex, Eve, and others) are AI-powered tools. They are designed to be helpful, opinionated, and useful for decision support — but they are not human advisors and may make errors.

3.2 Not Professional Advice

AI persona outputs are not legal, financial, medical, tax, or other professional advice. You should not rely solely on AI outputs for consequential decisions. Validate critical recommendations with qualified human professionals.

3.3 Your Judgment Required

You are responsible for decisions made based on your use of the Service. The AI personas assist; they do not replace your judgment.

3.4 Accuracy

AI-generated content may contain inaccuracies. Always review meeting summaries, transcripts, and derived insights for accuracy before relying on them.

4. Meeting Recording and Transcription

4.1 Your Responsibility for Consent

If you use AI Executives OS in meetings that include other participants:

  • You are responsible for ensuring compliance with recording and transcription laws in your jurisdiction
  • Recording laws vary: some jurisdictions require all-party consent, others require one-party consent
  • You must provide appropriate notice to meeting participants as required by law

4.2 Meeting Bot Disclosure

When a meeting bot joins a call on your behalf, it should be clearly identifiable to other participants. Do not attempt to disguise or hide the bot's presence.

4.3 Third-Party Rights

You agree not to use the Service to record meetings in violation of third-party rights or applicable law.

5. Acceptable Use

5.1 Permitted Use

Use the Service for lawful business and personal executive-support purposes.

5.2 Prohibited Conduct

You agree not to:

  • Use the Service in violation of any law, regulation, or third-party rights
  • Record meetings in violation of recording laws
  • Use the Service to harass, defame, or harm others
  • Use AI persona outputs to generate misleading, fraudulent, or deceptive content
  • Attempt to jailbreak, exploit, or bypass the Service's safety measures
  • Use the Service to automate actions on behalf of others without authorization
  • Reverse engineer, decompile, or disassemble the Service
  • Resell or redistribute persona outputs as a standalone product
  • Use automated means (bots, scrapers) to access the Service without authorization

6. Subscription and Payment

6.1 Pricing

Current pricing is published at theaiexecutives.com/pricing and may change with 30 days' notice to active subscribers.

6.2 Payment Terms

Subscriptions are billed through Stripe. All fees are non-refundable except as required by law or expressly stated.

6.3 Automatic Renewal

Subscriptions renew automatically unless cancelled before the renewal date.

6.4 Usage Limits

Some features (such as meeting minutes, SMS messages, or AI calls) may have usage limits based on your subscription tier. Overage charges apply as disclosed in pricing.

7. User Content and Data

7.1 Your Ownership

You retain ownership of your meeting content, transcripts, decisions, and data.

7.2 License to AI Executives OS

You grant us a limited license to store, process, and analyze your content solely for the purpose of providing the Service.

7.3 No Training on Your Content

We do not use your content to train general-purpose foundation AI models.

7.4 Data Export

You may export your data at any time through the Service.

8. Third-Party Integrations

The Service integrates with third-party services (Google, Microsoft, Recall.ai, Twilio, Anthropic, OpenAI, and others). Your use of these integrations is subject to the terms of those services. We are not responsible for the availability, accuracy, or conduct of third-party services.

9. Intellectual Property

The Service, including personas, prompts, algorithms, software, and design, is owned by AI Executives OS and protected by intellectual property laws. You may not copy, modify, or redistribute without our written permission.

10. Service Availability

The Service is provided “as is” and “as available.” We do not guarantee uninterrupted, error-free, or completely secure operation.

11. Suspension and Termination

11.1 Termination by You

You may cancel at any time through account settings.

11.2 Termination by Us

We may suspend or terminate your access immediately for breach of these Terms, prohibited conduct, non-payment, or at our reasonable discretion.

11.3 Effect of Termination

Upon termination, your access ends. Data is handled according to the Privacy Policy.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided “as is” without warranties of any kind. AI-generated outputs are provided without warranty of accuracy, completeness, or fitness for any particular purpose.

13. Limitation of Liability

To the maximum extent permitted by law, AI Executives OS shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service, including damages arising from reliance on AI persona outputs.

Our total liability shall not exceed the amounts you paid in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless AI Executives OS from claims arising from your use of the Service, your content, your failure to comply with recording or privacy laws, or your violation of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Disputes will be resolved in courts located in Florida.

16. Dispute Resolution

16.1 Informal Resolution

Before filing any claim, contact us at support@theaiexecutives.com to attempt informal resolution.

16.2 Binding Arbitration

Unresolved disputes will be submitted to binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association.

16.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive participation in class actions.

17. Changes to These Terms

We may modify these Terms. Material changes will be communicated with at least 30 days' notice. Continued use constitutes acceptance.

18. Miscellaneous

  • Entire Agreement: These Terms, Privacy Policy, and Cookie Policy are the entire agreement.
  • Severability: Unenforceable provisions do not invalidate remaining provisions.
  • No Waiver: Failure to enforce a provision does not waive it.
  • Assignment: You may not assign rights; we may.
  • Force Majeure: Neither party is liable for delays beyond reasonable control.
